Resolution 2005-37: Requesting the City Administration to Provide the Council All Pertinent Information Relative to Liquor License Applicants Prior to the Public Hearing on License Renewals and/or Transfers

A license transfer request which came before the Council in early 2005 caused considerable debate among Council members as some were of the opinion the applicant's history as a landlord shed some question onto his suitability as a liquor license owner. This resolution asks that in addition to the BCI criminal background check performed by the Newport Police Department, other city departments such as Zoning provide any pertinent information they may have regardinig liquor license applicants so that the Council sitting as the Board of License may make the best decision for the City of Newport. The resolution was co-sponsored by Councilor Coyne and Councilor Connolly.

WHEREAS, each year when liquor licenses are renewed, and during the course of a year when the ownership of a liquor license may be considered for transfer, the applications, upon receipt, are routinely forwarded by the City Clerk’s Office to the Police Chief, Fire Chief, Zoning Officer, Building Official, Clean Cities Administrator, and Tax Collector for their approval; and

WHEREAS,

the above action is in addition to a new applicant for a liquor license being required to appear at the Newport Police Station for fingerprinting and a criminal records check; and

WHEREAS,

Section 3-5-10 of the Rhode Island General Laws provides that no liquor license shall be issued unless the applicant is deemed suitable to hold a license. NOW, THEREFORE, BE IT

RESOLVED: that, in order for the Council to make an informed decision as to whether or not an applicant, including officers, directors and stock-holders of a corporation and members of a limited liability company or a partnership, is suitable to hold a liquor license, any known information with regard to the applicant shall be included on the routing form sent by and returned to the City Clerk’s Office. AND BE IT FURTHER

RESOLVED,

that information provided regarding an applicant for a liquor license be forwarded to the Council prior to the date of the hearing on the license transfer or renewal.
